Terms of Sale (Terms & Conditions of Sale)

These Terms of Sale (“Terms”) govern the purchase of products from Hotcalm (“Hotcalm,” “we,” “us,” or “our”) through our website (the “Site”). By placing an order, you agree to these Terms.

If there is any conflict between these Terms and any other policy on the Site, these Terms will apply to purchases, unless stated otherwise.

1) Eligibility

By placing an order, you confirm that you are at least the age of majority in your jurisdiction and that you have the legal capacity to enter into a binding contract.

2) Products & Availability

We try to display product information as accurately as possible. However, product descriptions, images, packaging, and colors may vary slightly depending on your screen or production batches.

All products are offered subject to availability. We may limit quantities or discontinue products at any time.

3) Orders

When you place an order, you are making an offer to purchase. An order is considered accepted only when:

  • payment is successfully processed, and

  • you receive an order confirmation (or shipping confirmation) email from us.

We reserve the right to refuse, cancel, or limit any order at our discretion, including (for example) in cases of suspected fraud, pricing errors, inventory issues, or abuse of returns/chargebacks.

If we cancel an order after you have been charged, we will issue a refund to the original payment method.

4) Prices, Currency & Taxes

Prices are shown in the currency displayed at checkout. Prices may change at any time, but changes will not affect orders already placed and accepted.

Depending on your location, applicable taxes may be collected at checkout.

Duties / Import fees (international orders): Customs duties, import taxes, and local fees (if any) are determined by local authorities and are the customer’s responsibility. Delivery may be delayed due to customs processing.

5) Promotions & Discount Codes

Promotions, discount codes, and limited-time offers are subject to the terms stated at the time of the offer and may be changed or ended at any time. Unless otherwise stated:

  • discount codes cannot be combined,

  • promotions are not retroactive, and

  • free gifts/bundles are available while supplies last.

6) Payment

We accept payment methods offered at checkout. By submitting payment information, you represent that you are authorized to use the selected payment method.

If your payment is declined, your order will not be processed.

7) Shipping & Delivery

Shipping timelines, costs, delivery estimates, and tracking are described in our Shipping Policy, which forms part of these Terms.

Delivery dates are estimates and not guaranteed. We are not responsible for delays outside our control (e.g., carrier disruption, weather events, customs clearance, peak demand periods).

8) Title & Risk of Loss

Unless otherwise required by applicable law, risk of loss passes to you once the order is handed to the carrier. Title to products transfers to you upon delivery (or as otherwise determined by applicable law).

9) Returns, Refunds & Exchanges

Returns, refunds, and exchanges are governed by our Return Policy, which forms part of these Terms.

If you are a consumer located in certain jurisdictions, you may have mandatory legal rights (including withdrawal/cancellation rights) that cannot be excluded. Where those rights apply, we will comply with them.

10) Chargebacks & Payment Disputes

If you have an issue with your order, please contact us first so we can help.

Unjustified chargebacks or payment disputes may result in:

  • refusal of future orders, and/or

  • suspension of customer support in cases of repeated abuse.

11) Warranty & Disclaimers

To the maximum extent permitted by law, products and the Site are provided “as is” and “as available,” without warranties of any kind except where required by law.

12) Limitation of Liability

To the maximum extent permitted by law, Hotcalm shall not be liable for indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising from or related to the purchase or use of products.

Where liability cannot be excluded, it will be limited to the amount you paid for the product(s) giving rise to the claim, to the extent permitted by law.

13) Personal Data

Our processing of personal data is described in our Privacy Policy. By placing an order, you acknowledge that you have read it.

14) Governing Law & Disputes

These Terms are governed by the laws of France, without regard to conflict of law principles.

Before initiating any legal action, you agree to contact us so we can attempt to resolve the issue informally.

If a dispute cannot be resolved, the courts having jurisdiction will be determined according to applicable law and your consumer protection rights (if any).

15) Changes to These Terms

We may update these Terms from time to time. The updated version will be posted on this page with a new “Last updated” date. Changes apply only going forward and do not affect orders already accepted.
